Terms of Use
These Terms govern the use of the Simptrip - Travel English app and of simptrip.com ("Simptrip", "we"). By creating an account, using the app or subscribing to Simptrip PRO, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the service.
1. The service
Simptrip is an app for studying travel English: phrases with audio, spaced repetition, listening and speaking exercises, an AI Tutor and Immersion in travel situations. The content is educational. We do not guarantee a level of English or a result in tests, interviews or immigration procedures.
2. Account
- You can use the app as a guest or create an account with email, Google or Apple.
- You are responsible for keeping your access secure and for the use made of your account.
- The app is intended for people aged 13 and over. People under 18 need the authorization of a parent or guardian.
- You can delete your account at any time, in the app, in Profile → Delete account.
3. Free features and Simptrip PRO
Some features can be used for free, with limits. Simptrip PRO is a subscription that unlocks the paid features described on the app's subscription screen.
4. Subscription, billing and cancellation
- Plans and prices: the available plans (for example monthly, quarterly and annual), the length and the price of each one are shown on the subscription screen, before purchase. The offer may vary by country and by store.
- Billing: payment is charged by Apple (App Store) or Google (Google Play) to the payment method of your store account when you confirm the purchase.
- Auto-renewal: the subscription renews automatically for the same period and price unless it is cancelled at least 24 hours before the end of the current period.
- Free trial: when offered, its length is shown on the purchase screen. At the end of the trial the subscription is charged automatically unless you cancel before then.
- How to cancel: on iPhone, in Settings → your name → Subscriptions. On Android, in Google Play → Payments and subscriptions → Subscriptions. Uninstalling the app or deleting your account does not cancel the subscription.
- After cancelling: PRO access continues until the end of the period already paid for.
- Refunds: are handled by the store where the purchase was made (Apple or Google Play), under each store's policies and applicable law.
- Price changes: are notified in advance, under the store's rules.
Nothing in these Terms limits the rights you have under consumer protection law.
5. AI and voice features
- The AI Tutor, Immersion and the speaking exercises use third-party speech recognition and artificial intelligence, as described in the Privacy Policy.
- Replies and evaluations are generated automatically and may contain mistakes. They are meant for language practice and are not immigration, legal, medical or professional advice.
- Do not share sensitive data in conversations, such as document numbers, passwords or card details.
- We may apply reasonable usage limits to these features to prevent abuse.
6. Acceptable use
You agree not to:
- copy, redistribute or resell the content, the audio or access to the app;
- reverse engineer the app or try to bypass limits, the subscription or security measures;
- use the service in an automated, abusive or unlawful way.
7. Intellectual property
The software, phrases, audio, brand and other content belong to Simptrip or its licensors. We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the app for your own study, for non-commercial purposes.
8. Availability and changes to the service
We may change, add or remove features. The service depends on an internet connection and on third-party services, and may be unavailable for short periods. Changes do not affect the rights the law gives to those who have already paid for a period.
9. Suspension and termination
You can stop using Simptrip and delete your account whenever you want. We may suspend or terminate accounts that violate these Terms.
10. Warranties and liability
The service is provided as is. To the extent permitted by law, Simptrip is not liable for indirect damages or for decisions made based on the app's content. These limitations do not apply where the law does not allow them, including consumer rights.
11. Additional terms for the app downloaded from the App Store
If you downloaded the app from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies, together with the following:
- These Terms are an agreement between you and Simptrip, not with Apple. Apple is not responsible for the app or its content.
- The license lets you use the app on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Simptrip is solely responsible for maintenance and support. Apple has no obligation to provide them.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the extent permitted by law, Apple has no other warranty obligation.
- Simptrip, not Apple, is responsible for addressing claims relating to the app, including product liability, legal compliance, consumer protection, privacy and third-party intellectual property infringement claims.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
12. Governing law
These Terms are governed by the laws of Brazil. Disputes will be resolved in the courts of the user's place of residence.
13. Changes to these Terms
We may update these Terms. The effective date at the top indicates the current version. Relevant changes will be announced in the app or on the site.
